A defendant's trial for causing grievous bodily harm with intent had not been unfair given that he had deliberately absented himself from the trial process and deprived himself of his right to call new evidence or other positive evidence which went towards his intent. The fact that he suffered from autism did not affect his ability to engage in the legal process.The Judge had considered his autism and put the Courts conclusions before the jury in his absence . The appellant had not simply absented himself from the trial but any pre-trial preparation which would have allowed him to have advanced his case .
