Judicial review was not the most suitable approach to challenging a refusal by the CPS of a request for disclosure of evidence which a man convicted of five murders said would undermine the case against him. The case was a complex one, reviewed repeatedly over 35 years, and the court was not in a position to say whether the CPS had erred in refusing to disclose the evidence. The Criminal Cases Review Commission was uniquely placed to review this case .
